Role Overview
We are looking for a highly experienced HR-Legal Counsel specializing in Vietnamese labour law, with a strong focus on employee relations and case management. This role will take ownership of complex and sensitive employee matters, ensuring all actions are legally sound, well-documented, and aligned with business needs.
The ideal candidate is not purely advisory but hands-on in managing real cases — including disciplinary actions, misconduct investigations, and terminations.
Key Responsibilities
1-Employee Case Management (Core Focus)
- Lead and manage end-to-end employee cases, including misconduct, poor performance, grievances, and workplace disputes
- Advise and work closely with HR on disciplinary actions, suspensions, and terminations, ensuring compliance with the Vietnam Labour Code
- Review case evidence, investigation findings, and documentation to ensure legal defensibility
- Provide clear recommendations on risk exposure and appropriate course of action
2-Investigations & Disciplinary Actions
- Conduct or guide internal investigations into employee misconduct, including serious violations and workplace incidents
- Ensure disciplinary processes are properly executed (e.g., notice requirements, documentation, union involvement where applicable)
3-Dispute Resolution & Escalations
- Handle labour disputes, including employee complaints, mediation, and formal proceedings
- Act as the escalation point for complex or sensitive employee issues, especially those involving potential reputational or regulatory risk
4-Policy & Compliance
- Ensure internal labour regulations (ILR), disciplinary procedures, and HR policies are legally robust and practical
- Strengthen documentation standards to ensure all employee actions are audit- and litigation-ready
- Identify recurring issues from cases and recommend preventive measures
- Work closely with HR and business leaders as a trusted advisor on employee decisions
- Balance legal risk with operational needs — providing solutions, not just legal constraints
- Support workforce restructuring, exits, and crisis management situations
Requirements
- Bachelor's Degree in Law; qualified to practice in Vietnam
- Minimum 6–10 years of experience, with strong focus on labour law and employee relations cases
- Proven track record of handling complex employee cases end-to-end (not just advisory)
- Deep understanding of the Vietnam Labour Code
- Experience dealing with labour disputes, inspections, and authorities
- Fluent in Vietnamese and English
