Legal Counsel – Construction & Procurement (APAC)

Our client is a fast-growing digital infrastructure platform. It develops and operates mission-critical facilities for some of the world's largest technology companies. It's backed by a global institutional investor, has a substantial development pipeline across multiple Asia-Pacific markets, and is scaling quickly.
The regional legal team is small, high-performing and close to the business. You'll work alongside senior leadership in a fast-paced, delivery-driven environment, with real responsibility and visibility from day one.
The role
This is a newly created role for a lawyer to lead the legal workstream on project execution: building the facilities, procuring the equipment and services they need, and supporting the contracts that keep them running once live. You'll work closely with the development, engineering, procurement, operations and finance teams across the region.
Key responsibilities
Construction and delivery
- Draft and negotiate construction contracts, including early contractor involvement agreements, letters of intent and award, GC and D&C contracts, substation, MEP and fit-out contracts, and consultant appointments.
- Advise on delivery issues including variations, delay and EOT, liquidated damages, defects, payment, practical completion, handover and commissioning, with a focus on avoiding claims.
- Support project teams on contract interpretation and risk management throughout delivery.
Procurement and long-lead equipment
- Negotiate supply, supply-and-install, services and framework agreements for critical equipment such as generators, chillers, switchgear and electrical and mechanical systems.
- Advise on title and risk transfer, delivery risk, warranties, testing and acceptance, LDs, security, insurance, liability and supplier insolvency.
- Build and maintain procurement templates, playbooks and fallback positions.
Project finance interface
- Review construction ancillary documents, including performance bonds, parent guarantees, collateral warranties, tripartite deeds and novations.
- Ensure project documents are financeable and that lender requirements flow into construction and procurement contracts.
- Track deliverables for financing conditions precedent.
Operations contracts
- Support operations-stage contracts, including maintenance, facilities services, security and fuel supply.
- Advise on service levels, KPIs, service credits and vendor default, and align them with customer commitments.
What we're looking for
- Around 6 to 12 years PQE, with an in-house role ideally in your background.
- Strong front-end construction, projects or procurement experience, including GC, D&C, EPC, supply and services contracts.
- Practical exposure to delivery issues such as variations, EOT, LDs, defects and completion.
- Data centre experience is a plus but not essential. Backgrounds in infrastructure, energy, industrial, logistics or major real estate development translate well.
- Project finance experience (lender requirements, bonds, direct agreements, bankability) is a major advantage.
- Commercially minded, able to separate legal risk from commercial and delivery risk, and comfortable making a call and owning it.
- Low ego, hard-working and resilient in a high-intensity, high-visibility team.
