Job PurposeJob Responsibilities
Legal Advisory
Provide legal advice and support to the business while keeping in mind thePVAs strategic and business objectives. Provide direction and guidance to facilitatePVAs compliance with all applicable international and domestic laws, rules and regulations. Collaborate with the Head of Legal to establish, disseminate and implementPVAs legal policies. Complete legal tasks and projects in a timely manner and respond to legal queries assigned by the Head of Legal.
Litigation
Supervise and is responsible for the adequate management of litigation or disputes betweenPVAand its customers. RepresentPVAbefore courts,prosecutorandpolicesat levelsto resolve matters in the best interest ofPVA. Report relevant litigation matters to the Head of Legal andprovidesupdates to the relevant stakeholders.
Legal Documentation and Review
Draft, review and negotiate contracts and other legal documentsin order tomaximizePVAs legal protections whilst simultaneously minimizing legal risks. Produce and regularlyupdatesstandardized legal agreements, contracts and standard terms and conditions for thePVAin compliance with international best practices and applicable legal requirements. Assist the business in launching new products andconductslegal and regulatory due diligence on such products.
Knowledge of External Environment
Stay abreast of new laws and regulations through continuous legal education, attending professional conferences, and participating in professional associations. Provide updates toPVAsManagementon new legislation and regulatory developments that may have an impact onPVAand advise on how to comply with such new legislation and regulations.
Knowledge Sharing
Work closely and develop a positive professional relationship with the other members of the legal function and shares legal knowledge and best practice with legal colleagues, including providing formal and informal training sessions at the direction of the Head of Legal.
Stakeholder Management
Liaises with external law firms and relevant authorities (such as courts) to ensure the effective resolution of all legal matters affectingPVA.
Job Accountability/Tráchnhiệmchính
This role is:
Non-claim, claim litigation handling to protect PVA's legal interest. Present as PVA's authorized representative at Court, police, procuracy. Preparation of supporting documents and co-ordination with the Company's outside lawyers (if any) in litigation/legal matters and make sure that Head of Legal and Management Team are well updated on litigation/legal matters.
Draft and review the Company's contracts/agreements.
Legal support and provisions of legal advice and opinions to all Departments in a timely and accurate manner.
Other tasks as assigned by Head of Legal from time to time.
JobRequirements/Yêucầu
Bachelor's degree in law or higher.
Seasoned experience as in-house or law firm counsel (7-10 years of experiences)
Industry knowledge and experience. Litigation experiences is a plus
Strong language skill in English and Vietnamese. Good communication and interpersonal skill.
Persuasive, problem solving, generalization skills and decisive
Be able to analyze complex issues, make sound judgments and propose different solutions.
