Job Purpose
This role is based in Hanoi, Vietnam and the individual will be the Legal & Compliance function lead for our TrueMoney business. This role will entail advising the business and seeing through our day-to-day business operations as well as support the Headquarter in Thailand on various regional projects.
Job Description
Reporting directly to the International Head of Legal and International Head of Compliance based in Thailand with a dotted-line report to the Country Managing Director, the Head of Legal & Compliance oversees and manages the Company's Legal & Compliance Practice of TrueMoney Vietnam and its related entities, functioning as an independent and objective body that provides Legal and Compliance advisory and overseeing all legal documents and corporate registrations, liaise with the regulators and the central bank, regulatory compliance and business licenses management, as well as provide support to other related functions within the organization. Successful execution is key for performing to support business growth, mitigate the Legal and Compliance risk and achieve long term business goals.
What you will do (Responsibilities)
Legal
- Manage and maintain the Company's legal practice to Headquarters standards.
- Review, draft, and negotiate all kinds of contract and legal documents relating to the Company's business, which include, but not limited to mobile financial services, cross-border payment and remittance, e-wallet, and consumer lending, as well as related legal issues such as corporate registrations, employment, intellectual property, and dispute resolution.
- Provide concise, comprehensive and practical legal advice and solutions to relevant functions.
- Create legal risks awareness to relevant functions and, where necessary, review, educate and give advice to the practice of said functions to ensure legal standards are met.
- Efficiently coordinate and build trust with all stakeholders (local, regional team, relevant functions, vendor), as well as liaison with external counsels.
- Support the data protection and data privacy practice of the Company.
- Report to and assist the International Head of Legal of all local and HQ on strategic deals and projects.
Compliance
- Discharge all responsibilities as the nominated Compliance Officer in accordance with regulations in Vietnam.
- Maintain strong relationship and communication with the State Bank and coordinate with them for any queries
- Ensure regulatory reporting requirements are met on a timely basis;
- Assist in the license application or renewal including all regulatory activities and requirements concerning it;
- Monitor and assist closure of regulatory, internal or external audit processes, and responding to administrative queries in conjunction with the management.
- Impact analysis of new policies and regulatory/in-country laws and regulations and provide guidance in the design and implementation.
- Render regulatory compliance advice on all aspects of compliance, including but not limited to AML/KYC, outsourcing, business continuity and technology;
- Evaluate the effectiveness of internal policies and procedures, analyze data and indicators to proactively identify weaknesses in policies and procedures and propose changes.
- Perform duties on AML/CFT for Customer Identification & Verification; monitor risk classification; conduct Enhanced Due Diligence (EDD) for high-risk customers; report suspicious transactions; and develop training materials and plan for company employees
- Regularly report compliance issues to company leadership and Regional Compliance.
- Develop the annual compliance work plan by adhering to the Regional guidance
- Support, participate and deliver Regional projects, issues and queries
- Perform other Compliance duties as assigned by the Managing Director or Regional Compliance, as may be relevant.
What you will need (Qualifications)
- Bachelor's degree or higher in law (preferably overseas postgraduate education but not necessary).
- At least 5-7 years Post-Qualification Experience; preferably having worked in a law-firm, business consulting firm, or financial institution.
- Managerial experience will be a plus.
- Strong knowledge of legal framework and regulatory compliance in relation to financial services, cross-border remittance, FinTech and IT, AML/CFT, consumer loans and title loans, and their relevant legal and regulatory requirements.
- Experience in data privacy and data protection is desirable.
- Able to communicate complex legal and regulatory issues to employees and stakeholders at every level.
- Excellent command of written and spoken English and communication skills.
- Have good business acumen, a win-win and can do attitude while able to adequately protect the Company's interest.

- Determined, punctual, and result-oriented to complete tasks and achieve goals.
